1. Platform Identity & Intermediary Role

This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. SmartTown (operated by Katthe softwares and solutions,India, Kadur/Bengaluru, Karnataka) operates strictly as an intermediary digital directory and civic communication bridge within the meaning of Section 2(1)(w) and Section 79 of the Information Technology Act, 2000.

2. 0% Sales Commission & Payment Disclaimer

SmartTown charges 0% commission on any consumer order, goods, or service rendered by listed merchants. SmartTown is neither a payment aggregator nor an escrow depository. Any financial payments initiated via direct NPCI UPI QR or UPI Intent pass directly between the citizen's bank account and the merchant's registered UPI VPA. SmartTown never holds, deducts, or touches customer transaction funds.

3. Prohibited Content & User Obligations

In accordance with Rule 3(1)(b) of IT Rules 2021, users and merchants agree not to host, upload, display, or share any information that:

• Belongs to another person and to which the user does not have a lawful right;
• Is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, or ethnically objectionable;
• Infringes any patent, trademark, copyright, or other proprietary rights;
• Contains misleading medical claims, illegal pharmacy sales, unverified financial scams, or hate speech;
• Threatens the unity, integrity, defense, security, or sovereignty of India.

4. Statutory Takedown & Content Moderation

SmartTown exercises proactive automated content safety inspections and community peer verification. Upon receiving actual knowledge in the form of a court order or authorized government notification regarding unlawful content, SmartTown shall expeditiously remove or disable access within thirty-six (36) hours, preserving statutory intermediary safe harbor immunity under Section 79.

5. Governing Law & Jurisdiction

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with the platform shall be subject to the exclusive jurisdiction of the competent courts in Chikmagalur / Bengaluru, Karnataka, India.
